General Terms and Conditions (GTC) for Instructors on ELEVEL

1. Scope
These GTC apply to all instructors operating their own educational communities on the [ELEVEL.io] platform (the “Platform”).

2. Subject Matter of the Agreement
The Platform enables instructors to create, manage, and moderate their own communities for educational purposes. ELEVEL provides the necessary technical infrastructure. Instructors may offer both free and paid content, such as courses, webinars, or materials.

3. Registration and Requirements
Use of the Platform as an instructor requires prior registration and approval by ELEVEL. By registering, instructors accept these GTC as binding. There is no entitlement to admission to the Platform.

4. Content and Liability
Instructors are solely responsible for all content they publish on the Platform. They warrant that they hold all necessary rights to texts, images, videos, and other materials. Content must not:Violate applicable laws, official regulations, or third-party rights, contain extremist, discriminatory, offensive, or pornographic material, harm the reputation of ELEVEL or other users.ELEVEL reserves the right to review content and block or remove it in case of violations.

5. Instructor Obligations
Instructors agree to:Provide truthful information during registration and profile creation, interact respectfully with community members in accordance with Platform and community guidelines, handle personal data carefully and in compliance with the GDPR, adhere to data protection requirements when communicating with community members, especially when exporting, storing, or processing personal data outside the Platform.

6. Advertising and External Offers
Instructors may promote their own related offerings (e.g., e-books, coaching, online courses on their own website), provided there is a thematic connection to their ELEVEL educational content and the advertising is done appropriately. Promotion or sale of third-party offers or unrelated products is not permitted unless ELEVEL has given prior written consent.

7. Compensation and Revenue Share
For paid content and communities, instructors receive 75% of net revenue after payment fees, unless otherwise agreed in writing. Settlements are processed monthly by ELEVEL (e.g., via Stripe). Payouts are made once a minimum threshold of €50 is reached. Important:
The revenue share applies exclusively to products offered and sold on the Platform. ELEVEL has no claim to revenue from external sales via third-party platforms or personal websites unless explicitly agreed otherwise in writing.

8. Usage Rights
Instructors grant ELEVEL a simple, non-exclusive, perpetual, and worldwide license to display, promote, and archive their content on the Platform and in marketing materials (e.g., social media, newsletters, screenshots). Commercial use outside the Platform (e.g., resale) requires prior written consent from the instructor.

9. Technical Availability

ELEVEL strives to ensure smooth platform operation but does not guarantee uninterrupted availability or specific features. Maintenance or technical issues may lead to temporary restrictions.

10. Term and Termination
The agreement is indefinite. Either party may terminate with 14 days’ notice at the end of a month.ELEVEL reserves the right to terminate immediately without notice, particularly in cases of:Repeated or severe violations of these GTC, Illegal conduct, or Behavior harming the Platform’s reputation.

11. Liability and Indemnification
Instructors indemnify ELEVEL against all third-party claims arising from their content, conduct, or breaches of legal obligations, including reasonable legal defense costs.ELEVEL is liable only for intent and gross negligence. Liability for lost profits, data loss, or indirect damages is excluded to the extent permitted by law.

12. Final Provisions
Instructors must comply with ELEVEL’s Community Guidelines, which outline behavioral standards for community interactions and form an integral part of the agreement. The current Community Guidelines are available at: www.elevel.io/en/legal/creators-elevel-community-guidelines

13. Governing Law and Jurisdiction
German law applies. For all disputes, the courts of Stuttgart shall have jurisdiction, where legally permissible.If any provision of these GTC is invalid, the remaining provisions remain unaffected.
